I was watching An Inconvenient Truth this evening when I saw a very familiar image.

They zoomed in a quite a bit, and made the taillights more red... but it's this pic all right.
Now I'm torn. Not sure if it's worth a big hassle to get the $150 they owe me. Or if I should spend a lot of time and effort to hold them accountable.

I'm not trying to be a Devil's advocate, but is it possible that they somehow took their own shot from the nearby spot?
I mean - it would be pretty hard to prove it to the judge, should it come to the court.
However, if you're sure it *is* your picture - I say, go and tear them apart! :thumb And I'm not talking about lousy $150... Maybe $150K :wink

I shot mine through a hole in fence on a freeway overpass. I couldn't duplicate the shot with a SLR lens, it would be too big.
And why would they go to the trouble of mimicking an Atlanta skyline shot? And it wouldn't be at all difficult to prove. Simply lay one shot over the other. They'd match perfectly. Why? Same angle and elevation.

Ummm, look at the shot. Does it appear to be a standard shot to you? :cool
Same sky, same shine on buildings, same traffic trails, same location (not a photog friendly location).
No, thousands of similar shots have not been taken.

It would be a very popular cityscape to take, and I don't know whether you would have had a long enough view in the movie to be absolutely sure it's yours.
If you believe your rights have been infringed, contact the producers and say so. Ask them to confirm who owns the rights and from whom they acquired a licence to use. Are you that certain?

Didn't your mother teach you better than that? :D They'll probably argue they didn't steal it, and if the original can be taken with a click of the mouse and reposted over and over, you could face an impossible trail of who took it. They may well be able to show you they did buy it, but not from you. Big can of worms......

I dont doubt it would be a pain in the ass to get reimbursed, as I said at the top of the thread. Proving ownership, however, would not be the hurdle.
Getting past the stonewalling and reaching the right person, could be incredibly time consuming.

It was on HBO, I rewound it and watched it again. But I don't have the DVD, so I can't take a piccie of the screen.

I bought that DVD a few weeks ago and have watched it a couple of times. It's an excellent eye-opener (pronounced debate starter) at the very least.
Anyway, the proceeds from the movie go towards helping the environment. They encourage sharing of the movie in the dvd case itself so as many people as possible see it because people need to see it. Whether they beleive it all or none or 10%, it's worth seeing and they want to spread the word however possible.
Given the purpose of the film, and getting as many people to see it as possible, I don't know how much you'd get if you could prove it's yours. But if it is yours, it's awful that it was used without permission, but what a great movie to be seen in! :) Perhaps rather than proving they owe you $150 it might be easier to get them to admit it was yours and they didn't have the right to take it, but to then grant them free use of it (it is for a good cause) for photo credit?

It would not be difficult to find out who to talk to. I could help you with that.
It's standard practice to charge an f-you rate for using your image without permission. You're right, don't bother for $150. You could go for much more than that. I'm not talking about a huge law suit, but you get the address, and then submit an invoice for the use of your image. I have a pro photog friend with experience with that kind of thing in the entertainment industry, if you want, you could speak with him.

I'm not gonna speak for everybody, only for myself. My only concern is to make sure you do have a bulletproof evidence if you decide to go to court. Otherwise, as an American saying goes, you will up up to a certain creek without a paddle...
I don't have that DVD/recording. But do you think you can pause the play and take the screenshot with your camera (I know it's lame, but it will get you a ballpark)? If not for us, at least for yourself, and, quite possibly, for the court?
I would not care much for the elevation/angle, but if all the windows in those buildings are lighted identically (Difference mode to the rescue!:-), then I say, you got your case solid and can go after them BIG time...
To prove you my attitude, I'm gonna make you a suggestion. You take that screenshot with your camera and tell me it's 100% identical from your POW. I will then go and rent that movie, play it on my PC, take an actual computer screenshot and provide you with an independent expert report (FWIW, I have two degrees, MS in math, BS in computers, plus NAPP membership), which you can then use in court.
How's that for scepticism :-) :wink :lust

Yes, this is the first thing that crossed my mind. I don't care for a credit, and the movie's for a good cause. But I harbor a sneaky suspicion that someone's pocketing a boatload of cash from this thing, Hollywood being what it is. So I'm not sure if I'm being an idealistic sap by letting it slide.

It's in the last quarter of the movie. The shot is full screen, about 60% zoomed into the buildings on the left, the white and red traillights are visible but don't dominate as they do in my image. The round tower is clearly visible.
For me, the shot is a cityscape with traffic trails. For them, it's a buildings shot, they didn't want too much of the traffic. They do a slow pullout. It's up for about 3 seconds or so.

And seriously, if they have your picture, how many other images did they heist? Assuming this is indeed your shot, somebody made the executive decision to go out and steal images without asking permission for an award-winning major studio production. What kind of message does that send around Hollywood? Or student film makers that they get away with this? Where does it end?

I also looked at the credits, they credit the still photos to many, many people. If that is your shot it's also possible someone else gave them permission and passed it off as thier own.

Did you put a copyright notice in the EXIF? Without that I can see a lot of people thinking the image was in the public domain. Putting a copyright in the EXIF may not protect a shot but it ought to at least keep honest people honest which, at the end of the day, is all you can really ask for.

Based upon the photo that Differntseed captured from tv and posted here - it is NOT the same photo. Just look at the lights that are on in the buildings and compare them to eachother - not the same. Compare the streaming lights from the passing and approaching vehicles - not the same. Just look at the tall building in the center of the captured photo from tv (No lights on) and compare that to WXWAX's photo - (Just about all the room lights on) - not the same.
The photos are similar but definitly not the same.
P.S. Your photo (wxwax) is so much better than the one shown in the movie.....

Yup, not the same picture. Also notice the two green traffic signs over the highway: in the TV picture, they're under the curved skyscraper; in the other picture, they're off to the right (and there's even a third sign that is missing in the TV version).
Very similar pictures, but not the same.

I'd get legal advice .... more than one opinion. If the case is clear cut that you have been wronged then I would think most attorneys would take the case under contingency.

Well, that's great news that it's not Sid's image. I was upset to think someone was 'stealing' your work. I thought about it and wondered how many of all of our images are 'floating' around out there. I did a search to see if I could find your image on someone else's site and I found this (http://www.shutterstock.com/pic-711718-atlanta-skyline-and-highway-at-night.html). Almost identical to the angle of your view, but definitely a different shot and no where near as spectacular in it's resulting image.

I agree, the photo posted here is not Sids, too many differences. Sids is better too. Some of the differences I noticed were, signs, building lights, angle seemed lower....I don't think PS could change all that.

not true. you may not have marked it as copyrighted, but as soon as you took the picture they copyright is yours.
Did you put a copyright notice in the EXIF? Without that I can see a lot of people thinking the image was in the public domain.

I was watching An Inconvenient Truth this evening when I saw a very familiar image.

Now I'm torn. Not sure if it's worth a big hassle to get the $150 they owe me. Or if I should spend a lot of time and effort to hold them accountable.

With all the bumping n stuff, there is something nice to this thread, it brings the Unconvenient Truth issue somewhat under attention. I think it is important for people to understand that some natural resources are dwindling and that we must take precautions for natural disasters.
While being serious, this is of course also a bump for this thread :barb
It all started when our predictably heroic hero, sid, woke up in a lemur-infested moor. It was the fifth time it had happened. Feeling excessively pleased, sid backhanded a carrot, thinking it would make him feel better (but as usual, it did not). A few unfulfilled decades later, he realized that his beloved camera was missing! Immediately he called his fundamentalist, guilt-dispensing friend, captain kangaroo. sid had known captain kangaroo for (plus or minus) half a million years, the majority of which were enchanting ones. captain kangaroo was unique. He was intelligent though sometimes a little... annoying. sid called him anyway, for the situation was urgent.
captain kangaroo picked up to a very happy sid. captain kangaroo calmly assured him that most legless puppies panic before mating, yet disease-carrying chipmunks usually wildly grimace *after* mating. He had no idea what that meant; he was only concerned with distracting sid. Why was captain kangaroo trying to distract sid? Because he had snuck out from sid's with the camera only ten days prior. It was a eccentric little camera... how could he resist?
It didn't take long before sid got back to the subject at hand: his camera. captain kangaroo yawned. Relunctantly, captain kangaroo invited him over, assuring him they'd find the camera. sid grabbed his rhinocerus and disembarked immediately. After hanging up the phone, captain kangaroo realized that he was in trouble. He had to find a place to hide the camera and he had to do it carefully. He figured that if sid took the gas-guzzling, ecology-destroying, tankish SUV, he had take at least eight minutes before sid would get there. But if he took the gogo mobile? Then captain kangaroo would be abnormally screwed.
Before he could come up with any reasonable ideas, captain kangaroo was interrupted by two stupid telly tubbies that were lured by his camera. captain kangaroo panicked; 'Not again', he thought. Feeling concerned, he randomly reached for his wolverine and aimlessly punched every last one of them. Apparently this was an adequate deterrent--the discouraged critters began to scurry back toward the fanstic pumpkin patch, squealing with discontent. He exhaled with relief. That's when he heard the gogo mobile rolling up. It was sid.

Seriously, though. It is. Pixel for pixel. If you discard the embedded aRGB profile and render it as sRGB, shrink it to 600px wide, and overlay it, it's definitely Waxie's (aside from a shoddy JPEG conversion). The car changing lanes in the lower righthand corner is exactly the same. With the way this thread's going though, I'd bet he did license out the rights to them :huh :D

Wow - who knows.
This was patented in 1976, and the exclusive rights to the patent expired 1991, if not earlier. So anybody could have made it/sold after the expiration date. The patent owner (assignee) was Mattel, but who knows if they ever made them at all.
Perhaps Andy could get a nice, framed print of this image for Sid?:D
I remember Sid saying he has a doll. I think he said it was a photographic large size, no wait uprezed doll, no I remember now, it was a blow up doll. :D

What may be an unstoppable buildup to a massive man-made global malady is thoughtfully introduced, expanded upon with conclusary future data brought to bear. Presented by Gore himself, with small ancillary biographical Gore vignettes throughout, this one-sided message is presented strongly and with ample scientific evidence. Not much contrary opinion is offered up in this documentary, and if this film has a flaw, that is it. The viewer is nonetheless bombarded with enough material to all but extinguish theories to the contrary. If we do not act responsibly, and soon, the Earth and Man is doomed. And perhaps, it is already too late.

I had my BS meter triggered early on in the movie when he showed a graph of the increase in C02 over the last few centuries. He pointed to the left of the graph which showed the level way at the bottom of the graph a few centuries ago. Then he made a big deal of standing on a ladder to show where the level is today, then projected that he couldn't reach where the level would be tomorrow. The implication was that the C02 had increased by some huge factor. The only problem was there were no numbers on the graph, nor did he mention any numbers. Hmmm....
A bit of googling shows that C02 has increased from about 280 ppm to 360 ppm, or around 27% since year 1700.
However, Gore made it look like it had increased a tremendous amount by neglecting to explain what the baselevel and increments were. It was a thinly disguised cheap trick to make a small change look huge. After that, I really had a hard time believing anything he said.

I just don't appreciate Al Gore's cheesey attempt to sensationalize the cause. It's just grandstanding. Why else would he stand on a ladder making wild gestures and claims without ever actually citing the number?

But its true, its more likely when than if, will our images get taken by somebody, intentionally or unintentionally.
That 911 photo example is a good one. Is there any other articles relating that same case, such as a follow-up or anything?

I am wating for the follow-up which I believe will be a decision on damages (assuming the A.P. does not appeal).
I track these things (occasionally) as part of my full-time career - mostly with regard to patents. So sometimes its hit -or - miss when it comes to copyright cases.

I can see several office light diffrences in the picture...Also, the building to the right of the two tall buildings in the middle of the picture is spaced away from it. Where in his pic they are photographed as being over lapping? I know you can do a lot with photoshop, but can you move buildings? :dunno
