Can't hid 'add comment' in a gallery.

I had it set up to NOT allow comments, but it still shows the add comment button...and a description of 'no photo comments' or something like that...
Uhm - how do I get rid of it when it shouldn't be there in the first place? I have it set in customize gallery to NOT show comments already.
The odd thing is, it doesnt show when logged in, but it does when logged out (as a visitor)

EDIT: When I log in to see that gallery (of one photo) that is forced to show the image as a large image. And then I log out, it then shows that gallery as SM small(ish).I have to reload the site (hitting home) then go back into that gallery to see it properly.
EDIT #2: I notice the new upgrades don't apply to that gallery as it is NOT set up to smugmug style (forced to show the one photo in the gallery as a large imaeg).
