I've had to watermark all my images because I found people cropping my © off the corners and using them elsewhere. To top it off my biz partner had an image swiped that some bozo went on to enter into a Ski Utah photo contest. Funny thing is the pic won, and seeing how my biz partner is a sponsored skier in Utah he saw it. Now we are fighting to get the rights to the photo (that were given up when it was entered) back. :scratch:dunno:huh:rolleyes

Wow. That is crazy. Some people do really suck. I think the PROOF across the front of the image can sure help. Be really nice if people just paid for the images they wanted.

Question, how do you find out if people are taking images? Are you just randomly seeing them or do you have a defined method of actually finding out?

The only way is to see them turn up in other places. If it's your own server you could see that someone is posting your pic somewhere on the web and leaching your bandwidth, but there's no way to tell if someone saves a pic to their HD.

Was your business partner's photo registered with the copyright office? Most contests have wording in their entry rules something to the effect of "You are the original developer of the content, including, but not limited to, the material, text, data, and other works of authorship used in the content." (taken from another thread in this forum). Basically, you have to be the creator of the image or be able to prove you have permission from the copyright holder to enter it. If your partner has the copyright certificate from the copyright office, I don't see how there can be a problem. If they refuse to return the rights (that they don't even legally own), your partner should retain a lawyer and sue, both the contest holders and the person who stole the image in the first place.
