When just looking around I have noticed several sites having the SmugMug-cobranding footer eliminated. Are we "allowed" to do that now?

You can do it in the Easy Customizer.

Take a look at the release notes from back in April:

"The Easy Customizer allows complete removal of SmugMug’s footer for Pro subscribers, even the “Powered by SmugMug” bit."
