View Full Version : URGENT call for photos

Ack! I'm so sorry about the short notice but there's nothing I can do.
smugmug has been asked to power the photo galleries of a major, prestigious conference, whose name I can divulge Sunday night.
They've invited us to provide a gift to the 630 attendees, which they would receive in a gift bag from companies like Apple.
We've chosen smug mugs. That is, white ceramic mugs with a stunning photograph and a quote about photography.
The ideal would be several photos, up to 20 of them, and different quotes, to go on different mugs so the attendees compare. I can put the name of the photographer tastefully in small type on the photo, if you want me to. And I'll use a variety of quotes.
The space available is 3.5" by 8.5" and part will be dedicated to the quote. Depending on the length of the quote, the photo might be 3.5 by 5, for example.
Stunning photos of Yosemite or whatever. Post them here, send me a PM, send email to help, whatever. We just need your permission to use them as gifts for this conference without, ehem, paying you. :uhoh
Thanks!
Baldy

Did I mention that I have to submit the artwork to the lab by Tuesday night at 8 PM pacific time, May 17th? That gives us about 24 hours realistically, by the time I have time to prepare them for print.

Baldy, what looks best on a mug? I just cannot make myself send you anything without seeing others, I just can't. I have never made KPOTD or anything. Other than that I have Hallmark type stuff, good for mugs????
And I am not sure what you mean on the size, we should size it and put the type of with a quote of our choice?
Tues, nite? I mean I could do it pretty easily, but birds, dogs, flowers, sunsets, lots of strangers who have never given me a release (that is just for humor).
Why doesn't someone post things like one would expect.
ginger
How are you going to get photo plus type to show up? How big should type be?
Frames? Anyone have a photo of a mug, to put on a mug? I don't.

So landscape orientation only, sounds like.Portrait's okay.
Here's some quotes we fished out of Bartlett's, I think, unedited (some are too long):
Edward Steichen
Photography is a major force in explaining man to man.
Also:
Photography records the gamut of feelings written on the human face, the beauty of the earth and skies that man has inherited and the wealth and confusion man has created.
I always thought of photography as a naughty thing to do—that was one of my favorite things about it, and when I first did it, I felt very perverse. Attributed to Diane Arbus
The sheer ease with which we can produce a superficial image often leads to creative disaster. Ansel Adams
What each man does is based not on direct and certain knowledge, but on pictures made by himself or given to him…..Walter Lippmann
The magic of photography is metaphysical. What you see in the photograph isn’t what you saw at the time. The real skill of photography is organised visual lying. Terence Donovan
I have no fear of photography as long as it cannot be used in heaven and in hell. Edward Munch
Blessed be the inventor of photography! I set him above even the inventor of chloroform! Jane Welsh Carlyle
Too many photographers try too hard. They try to lift photography into the realm of Art, because they have an inferiority complex about their Craft. Jessie Tarbox Beals
In photography the goal seems to be to prove beyond a doubt that the cameraman, in his great moment of creation, was either hanging by his heels from the rafters or was wedged under the floor with his lens in a knothole. E.B. (Elwyn Brooks) White
Most things in life are moments of pleasure and a lifetime of embarrassment; photography is a moment of embarrassment and a lifetime of pleasure. Tony Benn
To photograph is to confer importance. Susan Sontag
[photographs] trade simultaneously on the prestige of art and the magic of the real. Susan Sontag
It takes a lot of imagination to be a good photographer. You need less imagination to be a painter, because you can invent things. But in photography everything is so ordinary; it takes a lot of looking before you learn to see the ordinary. David Bailey
…people are always anxious to see anyone who has made himself famous.... Photography ... offers the most complete satisfaction of our curiosity. Arthur Schopenhauer
…the point of photography is to isolate images from context, so as to make them visible in a different way. Neil Postman
I’m not a photo opportunity kind of person. I am at an age where I have better sense than to make a fool of myself. Lynn Schenk
Because each one of us forgets different things, a photo more than a painting may change its meaning according to who is looking at it. John Berger

Wider ones would get bigger quotes. I'll try to mock one up in the next few hours when I get a sec.
Audience: male in their 40s, senior exec. We want them to (a) enjoy their mug, and (b) see something in the photo they can relate to. That's why I was thinking of the first B+W. It felt like they'd identify with important family moments, their legacy, role as parents, think about their own photos.

So thinking more about the minds of the audience... I believe these quotes would mean a lot to them:
To photograph is to confer importance — Susan Sontag
…people are always anxious to see anyone who has made himself famous.... Photography ... offers the most complete satisfaction of our curiosity — Arthur Schopenhauer
Most things in life are moments of pleasure and a lifetime of embarrassment; photography is a moment of embarrassment and a lifetime of pleasure — Tony Benn
Photography is a major force in explaining man to man — Edward Steichen
I think a photo that moves them to think about their own photos, family, life is better than moving them to think, "Ansel was a great photographer and doesn't his work look better on a big print than on a mug..."

These are not worked up at all, and I am going to watch the last raymond, but these are the two different sizes you mentioned, as far as percentages. I am not saying they are good photos, I am saying they were the first I saw, and I am busy right now.
http://gingerSnap.smugmug.com/photos/22278863-S.jpg
that is a ratio such as 5 X 3.5
this is the 8 X 3.5
http://gingerSnap.smugmug.com/photos/22278865-S.jpg
Very different ratios, even as relate to the blk and white with the child. That is one thing that has me very confused.
I will come back at 10 to see what you all have decided and if I think I can help you.
uh, all men do not relate to kids, in my experience. funny, do you have funny. such as the frog that went KPOTD around christmas, etc.

I just had a thought about that picture. It's a great picture but how conservative are the people at the conference. If they are conservative and say have a 14 year old daughter they will not want that picture on a mug in their house. Now if they are in their 20's they will ask where they can buy 15 more of them.
And how much are they gonna cost? I'd order that mug.

Select "click here to see a slide show" to get the image number, which I'll need.
You are more than welcome to use any of these images on the mugs, and please do credit me as photographer "Dee Golden."
But please let me know tonight, as I have to get on a plane tomorrow for NY...
I'd be more than happy to send you the high res files, good size for mugs, I'm sure. I have most of them in .psd format, let me know size and resolution, and format (jpg, tiff, psd, etc.) needed and I can resize and get them to you by midnight.

Obtaining the usage rights to photos for the use that Smugmug has in mind seems to be a clear, as this thread and the individual photographer's positive responses takes care of that issue nicely.
But... the quotes? What, I wonder, are the legal ramifications, of placing quotes on a product, for promotional purposes, of those of notoriety, that may already be copyrighted by themselves or their heirs and successors?

I would NOT use anything that isn't model released. Property, if they're on the list as requiring releases, you'd be taking your legal life in your hands. Most property isn't subject to that. If you're using it for commercial gain, then you can't use famous people, I think. Bert Krages Legal Handbook For Photographers is a good source.

Baldy, I put type on my photos, the correct size I think. When I woke up, I thought, oh darn, what did I do? About 3 AM, I start to thinking I am a good photographer, bar none. No, I don't drink.
I do have the same photos avail, without type, but I have to leave for awhile.
I don't know what time I will be back.
Please leave me a message if you need my stuff changed, or whatever, PM me or leave the message here.
I see some really good stuff offered. I just went through my hard drive and looked. I tried not to use complicated shots, I do have a few dynamite photos, just did not think they were mug photos, and what is dyanamite to me......etc.
I tried to mix it up. I know the guy, the one kite surfing, a release is no problem.
I wish I were going to be here this afternoon, or that I had never started being involved.
As a note on fame.
Barnes and Noble will no longer let me photograph, ANYTHING, as I was photographing a photo, a good photo, on a book re Johnny Cash. They implied I was breaking copyright laws on purpose. I was just trying to get the feel of books, for no reason whatsoever.
That might give you an idea, though, re releases. On the famous. I don't know who you are talking about, it would kind of help to "know" your person. Some people are not going to go to the work to sue..........it is work. famous people do it to prove a point. Then they would get an article written on them attacking a nice company like smugmug, etc. Just MHO. I am too scared, and I break many rules.......but I am scared, especially when it comes to kids.
I have those, too. But I didn't think of my family last night, and they would have been safe. I would not go heavily on family of others unless very good. I don't, personally, and others don't, really care that much about other people's kids. They might be cute and all, but not with my coffee.
Also, the gender angle, people will/ could be taking mugs home for wife, partner, etc.
And why are all these people males????

Everyone: these are GREAT and I so appreciate the response at short notice. I'll be preparing pics until 8 tonight Pacific Time so maybe I'll get 20ish with quotes?
Question: what's the legality of having an image of a well-known persona or product on something like this where we place our brand on it?Don't know the answer. I've used this shot for my own promo because it was shot at a very public event and it isn't showcasing any particular name, logo, etc. And anyway, I'm a tiny fish compared to a big fish like smugmug!
I could do some photoshop work and replace all the logos with smugmug "grins"?? Nah, I guess that would really be bad . . .
What if this were a Nascar shot with tons of brand names, or an "Andy" NYC street shot with a fedex truck somewhere in the frame? And aren't certain landmarks protected? Maybe El Capitan requires natl park permission:rofl .
Baldy, have fun choosing. LOTS of great shots have been posted.

Not permissable, unfortunately. As Lynnsite says... models are releases needed for recognizable faces/figures. Can't use brands without a release. If the shot was taken on private property, need a location release.
These images are being for commercial gain, and so are subject to the most extreme rights restrictions.

Okay, gut check: this would be final art for one of the mugs assuming I don't have a typo, you don't think I've done a tacky job, etc.:
http://cmac.smugmug.com/photos/22347872-O.jpg
The breaking news is we could only get gift boxes for the 11-ounce mugs, which have pics of 3.0x8.5" (quite pano) or 450x1275 pixels.
Type the right size? Pic on the correct side? Copyright notice okay? If so, more to follow.

I like... Might I make a suggestion? Instead of putting the Copyright on the PIC, and detracting from the PIC, can something like "Photo by Ed Hughes" be put below the Smugmug logo?

This one in particular is easier to see in the white style, lower left, since the mugs will be white and there's a 1px black border on this one.
Also, someone mentioned the text not being centered. Good point but the reason is there's about a half-inch white space to one side of the image between it and the handle.

I agree with Seymore about the photog name placement, but suggest you might put it to next to the photo at the bottom right side rather than under the Smugmug logo. You might also want to center the type on the white area (or put it closer to the photo...the mugs can't be that large, LOL!).
Photos of people can be used if their identities are not recognizable (as in silhouette or they are soooo small you can't tell even with a magnifying glass). However, feel free to use my photo of my grandson (or any others of him you'd like) as I can get you a model release for him (and give you permission to use his likeness as well). I'd always thought that people in public events (such as sports, parades, etc.) or celebrities (in public) were fair game and did not need model releases to have their likenesses used, but it's probably best to be safe rather than sorry.
Good luck tonight, Baldy...you certainly have your work cut out for you!!!

Beauty can be as isolating as genius, or deformity. I have always been aware of a relationship between madness and beauty.
Just advertising departments with legs and high heels.
Just shorten that first one to "..a relationship between madness and beauty." or just "... madness and beauty."

I'll give an update when I get a chance but I have a fire to put out: I placed the copyright notices too close to the bottom in the bleed/trim area (something I tell our customers to never do) so the bottoms of the letters are getting lost.
We ended up with 15 variations of photos and quotes (my goal was 20, but 15 great ones is still great). A few variations went overboard at the last minute because other smuggers felt the quote wasn't powerful enough, or I didn't have permission (didn't get Ashley permission for the edgy one 'till this a.m. 'cus she was offline yesterday), or I couldn't find the original version fast enough in your galleries, or portrait mode didn't work on so wide a mug, etc.)

Yes I can imagine the response.......
So why no payment?
SmugMug is not free and is increasing charges vastly. Run as a business, as it should be that's not a problem....
The mugs are for a business venture that unless I'm very mistaken will not be provided free. The fact that the mugs are handed out free to advertise smugmug means nothing.
Could Baldy manage to send the 'lucky' people a free mug maybe? or what about giving out a 'free' upgrade to pro-account for those used if money is so tight....
Anything as payment, rather than what looks to me like a cheap method of gaining free shots and one that from any other source would have been greeted with outright rage from more than a few......
It's always nice to help out people out but this seems strange to me...
Dig into your pocket/business account and do this properly or lets hear why not....

As for nobody asking for payment after post 1 saying 'you ain't getting one' who would want to mention it after that comment. Now after the event I'm asking why?
I'd laugh along with you if I had the slightest idea what the joke was....:dunno Gee I guess you just straightened me out !!
Sorry, I really can't answer your question as to why no $. Don't work at Smugmug, just play here.
The "We" actually meant you and me, cause I thought for sure someone so interested in being compensated would have been one who submitted an image, go figure ??
Sorry as well about your sense of humor, or lack of it. Gotta go now and get out more.

smugmug has a lot of different types of users. Casual users, who pay for services they use, and never look at this forum. Pro users who pay and never look at this forum. There are users that are on this forum just to share images, some just to learn about API.
There are many customers here who have a connection with the people at smugmug. They are good people, a family owned and operated business. Kind, responsive people doing their best. By being so available to their customers, they have established a relationship with many that goes beyond just providing a service. I experienced this up at Yosemite. Sure, I paid my way, but in return I got a dinner hosted by smugmug, a hat, a fleece, and the expert advice of Marc Muench, an amazing landscape photographer. All this for my $30 annual subscription. Not to mention the amazing customer service that I've had here.
smugmug is a building business that has earned the right, IMO to ask for some help from it's customers that have benefitted from their hard work. Not that you have to give them anything for free, but there's plenty of us that don't mind. If you do mind, don't participate. But there's no need to complain about it after the fact.

Feeling a bit bolshy, Bodwick? :evil
Baldy made it utterly clear in his first post that there would be no money involved. Anyone who wasn't comfortable with those terms didn't have to submit anything.
Turns out a lot of people were comfortable with those terms. That's their business. Not for you or me to second guess them.
I understand that it seems odd that a business would ask for free images to promote itself. I think DavidTO did a nice job of explaining why folks who clearly understood the very issue you raise, decided to let smugmug use their images with only a credit. I might add that some of the donators are people who regularly sell their images.
As I said, that's their business, no-one else's.

A few days ago, I just wanted to know what is wrong with my photos.
Challenges, free offers of photos. If I paid someone would they take them, other than family and friends.
I do think that is a legitimate feeling that I set myself up for. I think I can handle the challenges, if not, I will get out.
But I just cannot respond to emergency calls for photos that don't turn out to be that urgent: lots of photos poured in.
At the time of the call, it was not about the money. It still isn't. It was stated at the beginning. I just wanted to help. Set myself up for another letdown at a time I felt full of them.
Life goes on.
What was wrong with my photos? compared to say the great pros like Andy, haha, of course, I understand that.
Just ranting.
Yes, I am feeling a bit of whatever one wants to accuse me of. Now I have to hunt up Baldy's site so I can see the mockups as they played out.

Okay, an update:
The conference starts tonight and it's called D. It's Walt Mossberg's conference on all things digital. He's a noted Wall Street Journal columnist on technology.
It's the third year for the conference and Kodak/Ofoto was the official photo sharing site in the two previous years. They asked if we could do this on pretty short notice, but the site was the easy part. It's at:
d.smugmug.com (http://d.smugmug.com)
Strangely, the gifts were the hard part because the other companies giving gifts were pretty wealthy and well-known brands. What could we give that would stand out?
We passed a number of ideas by the show organizer and they all feel flat. Been done, etc. So I came up with the mug idea from the photos we saw come out of Yosemite. By that time, we were down to the short end of a very short wire.
The goal was 20 mug/quote combinations. It didn't turn out to be so easy and near the end of my deadline I only had 10 that really popped. So I did the quick & easy thing and plundered Andy's galleries and came up with 5 more.
Unfortunately, not all of them made the cut after we saw the production on the mugs. Some photos reproduced beautifully on white ceramic and some didn't.
So, I'm re-working some art as we speak and tonight I'll load final art for the ones that turned out to be prime-time. I suspect we'll have 12 total. Still looking for photos to go with the rest of the quotes that really moved us, so we'll need about 6 more photos in time.
Once I get the gallery of final art, I'm happy to order mugs for anyone who wants them.
Sorry about the non-payment thing. I knew that would ruffle some feathers and that's understandable. We pay for photos we use in ads, etc. But the fuse on this was too short to negotiate payments & rights, get a contract drafted and signed, etc. So we just decided to draw on passionate amateurs who wanted to see their photos on gifts. We knew it meant forgoing the photos we could have had if we paid. I tried not to put pressure on anyone who does this for a living to give us their photos for free.
All the best,
Baldy

Isn't amazing how photos reproduce on various things?
A shot that is stunningly beautiful on photo paper maybe doesn't cut the
mustard with another reproduction process or media.
Gives you a little more insight into the art director's world. Doesn't it?

Yeah, it turns out that the photos which worked best here were landscape and the more pano the better.
Also, not too much detail, because the small mugs are only 450 pixels vertically.
And, since the mug curves, it has to be compelling when you just see part of the shot, because another part isn't visible unless you rotate the mug. If Bridal Veil Falls in Yosemite makes the shot but you can't see it when you glance at the mug from some angle, that shot's toast as far as mugs go.
And there was something magic when they fit the quote perfectly. I have a collection of great shots that don't quite fit my quotes. It's painful to look at them and think there must be some quote I'm missing...

Hi Baldy,
I'm shocked that you were able to get Andy's pic of me on a small mug. I haven't been able to fit into a small size myself for years.
Of course you know I never signed a model release for that shot. You have a choice here before I call my lawyer. Either you recompense me with a 500mm/f4 lens (nikon mount of course) or if that's too much I'll settle for a mug. :D

Seems to me it's in the interest of smugmug and the photographers to have this happen, so I set up two galleries with final art, one for small mugs and one for large:
http://cmac.smugmug.com/gallery/541252
http://cmac.smugmug.com/gallery/549683
The coyote and New York skyline shots are not in the large gallery yet. I may have to adjust the New York skyline a little after seeing a production mug because the blues on ceramic are a little saturated.
You have to use the no-crop option and for reasons too involved to explain, on mugs the no-crop option will look funny (the two white strips are too fat). In fact, with the no-crop option they'll print fine.
So there's only one remaining issue that I can think of: we didn't ask for free shots to sell the mugs at a markup, we asked if we could give them as gifts. Does this give heartburn to the photographers involved?
Currently I mark them up a penny so that I can see how many of which are being ordered, but smugmug makes a markup based on EZ Prints charging us less than our retail. And I have no way to set the shopping cart prices to wholesale.
If we were to sell a lot of mugs and I had to track, report, collect 1099 forms, pay, etc., I'd be in for more work than I bargained for. I don't mind the payment, it's the work.
My guess is sales are going to be fairly small and limited to dgrin friends, so can we just let this go or am I sounding like an evil, lazy cheapskate? :uhoh

Jun-01-2005, 04:04 PM
So, update....
1. I got the next test batch back and two things remain to fix. One is the photo tends to bleed on its edge if I get it too close to the handle, so I have to add 1/4" of white there. The other is the blue is too saturated, so shadow areas by Ed's Coyote turn out bluish and Shay's New York Skyline is awash in it. So I need to desaturate the blues a bit.
2. I made up two more mugs with Marc Adamus's shots and will display them here when I'm sure he's passed off on how they're handled. That brings us to 19.
3. O'Reilly, the company that organizes some pretty influencial technology conferences, was at D where we gave these mugs away. They've asked if they can get them for a conference they're doing where they'd need 2,000 mugs... We're considering.
The thing is I think they'd be most appreciated & have the biggest impact at shows with photographers, so we're thinking where best to spend our meager mug budget.
Thanks,
Chris

For those that may not know. O'Reilly (not the AM talk show host) is on
of the better publishers of technical books. Especially their "nutshell" series.
Of course now, I just look for the O'Reilly brand first and then compare. Most
likely, O'Reilly wins.

It's true, for those in the know the O'Reilly brand of computing books is the best there is.
I used to own a chain of technical bookstores and I'd watch customers come to a subject area on the shelf and just pick the O'Reilly titles.
I love the cool covers they use:

I took the first two photos with a Canon Digital Rebel (you can check out the EXIF by clicking on them). The first was using the original Canon 18-55 mm kit lens while the second one was done with a Quantarray telezoom (70-300 mm). The third was taken with an old 35 mm Canon point-and-shoot using B&W film.
