Added New Gallery but the Banner is not there

Hi

I've added a New Gallery (Nightshots) to my pages but my Banner
is not showing only the SmugMug one
Also all the links in the footer have re appeared which I got rid of in my previous pages

how do I get my banner to appear on New Galleries added?
and how do I remove the links in the footer on New Gallery added?

I just assumed once the code is in there it will be hidden.

Make sure "custom" is checked for appearance under customize gallery and hide owner is not checked.
